TERMS AND CONDITIONS OF USE AND SERVICE
These Terms And Conditions of Use And Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You,” “Your”) and honeymoon.tours (“We,” “Us” or “Our”), concerning your access to and use of the honeymoon.tours website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”) for the purpose of contributing towards a cause as defined by the You as the fundraiser.
USE OF SERVICE AND CONTENT
The Site provides an online crowdfunding donation platform for specific honeymoon trip’s expenses that you have selected from the Site based on your knowledge, familiarity and agreement to pay for the trip as described in the crowdfunding page. The Site and its original content, features, and functionality are owned by honeymoon.tours and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
It shall be Your responsibility to ensure that the names of You and Your spouse must correspondingly be the same as that shown on his/her valid official travel document or passport which will enable tickets, if any, issued under these names to meet the legal requirements of TSA, transport carriers, hotel suppliers and domestic/foreign governments. Please note that transport carriers, such as airlines or cruise lines, and hotels do not normally allow guests the flexibility of name changes without fees or penalties after purchase confirmation. Incorrect names may constitute a cancellation and may subject to imposed cancellation penalties and/or fare changes.
It shall be Your responsibility to affirm any inclusion or exclusion with our honeymoon travel specialists when in doubt. You hereby acknowledges that the self-purchase of your own U.S.A. domestic transportation tickets/passages is at your own risk. honeymoon.tours and/or its affiliated agency/parent company/subsidiary reserves the right to change the international air carrier used that may affect the travel date and/or time without prior notice.
In the event when due to circumstances beyond control, such as and not limited to the arranged hotel(s) become unavailable, We reserve the rights to substitute hotel accommodation(s) with that of a similar category without prior notice.
Recognizing that unforeseen circumstances can disrupt and/or cancel any carefully arranged journey, we strongly recommended for Your protection, that travel insurance, that is not included in tour price, must be purchased for every planned trip.
FEES FOR SERVICE
There is no fee imposed for the normal completion of this service on this Site. However any cancellation of account after gathering the initial solicited fund into the account will incur cancellation penalties.
You acknowledge that any voluntary change to your honeymoon selection once you start your crowdfunding process can only be accommodated one time by contacting Us at least 60-day in advance before the departure date or before the crowdfunding period ends. In such an instance, small administrative charge of $100 shall apply.
All honeymoon tour fares are in U.S. Dollars. Tour price is guaranteed once Your account receives full funding.
In the event when there exist any unused tour feature either on air transportation or land arrangements, including but not limited to optional excursions/tours/meals, hotel accommodations and upgrades, they shall expire without refund. They are deemed as non-transferable, not applicable as current or future tour purchase/payment credit, and cannot be substituted for other options.
You acknowledge sole responsibility for any excess baggage charge, baggage check-in fee where applicable, and that baggage is at the owner’s responsibility throughout the tour. Some airlines may impose additional charges if guests choose to check in any baggage. You are aware that We only make flight reservations for the journey and that not all air carriers include complimentary check-in baggage service or complimentary baggage allowance for any booking, baggage allowance may vary for different transport carriers, and may change at any time. We assume no responsibility for such current or future baggage allowance policies of any transport carrier, its cost thereof, liability for loss, theft or damage to baggage or its contents, or delay of baggage in transit to, from or while on the trip. You also agree to the responsibility of confirming baggage allowance and policy directly with the transportation carriers and will assume the associated costs where applicable. For up-to-date baggage allowance restrictions, always check with the appropriate air and/or cruise carrier for the latest regulations and fee policies before departure.
Due to the ground transport/bus space limitations and for the sake of efficient travel convenience, You are strongly recommended to travel at most with one check-in luggage and one small hand-carry item per person.
Your passports must be valid for at least six months from the return date of the trip, and at least two blank pages must be available. Non-U.S. passport holders are required to consult with a travel agent, the foreign destination’s Embassy or Consulate Office for entry requirements. You acknowledge that We do not assume any responsibility for Your improper or invalid passport(s).
You acknowledge the full responsibility to obtain any required tourist entry visa(s) for yourself and your companion in a timely manner prior to the tour departure date. You are requested to consult with a travel agent or the destination’s Embassy or Consulate Office in order to inquire or apply for any tourist entry visa where required. We are not responsible when you and/or your companion is/are denied entry into any country for any reason even with the possession of a valid passport(s) and valid entry visa(s).
We recommend that You and Your companion be in good health. You are requested to consult own physicians regarding individual wellness and ability to travel long distances. Some of our tours incorporate active elements such as ingress and egress from buses and vessels, walking long distances, or sightseeing; You are responsible for familiarizing themselves with the level of activity that will be involved in the tours. Any existing physical or mental illness, disability, pregnancy or any other condition which may create a health hazard for You or others during the tour which may require special medical attention or special accommodation during the tour must be disclosed to Us at the time of registration (or at later time when You become aware of such a condition) for a determination of type(s) of assistance that can be reasonably provided. We will make reasonable efforts to accommodate the special needs of disabled participants, but is not responsible for any denial of services by carriers, hotels, restaurants, or other suppliers. We regret that special needs for ordinary daily activities, such as walking and dining cannot be accommodated. In no instance will Our suppliers or their employees physically lift or assist You or Your companion on to or off any vehicles. If Your special needs cannot be accommodated, You must be accompanied by a qualified companion who will be responsible for independently providing such needed assistance. We reserve the right decline anyone from the tour whom is considered as unsuitable due to fitness level.
You are responsible for respecting the authority and following the directions of the tour guide and the laws of the countries to be visited in the tour itinerary. We may exclude anyone from participating in all or any part of the tour if, in Our sole discretion, the person’s condition or behavior may render himself/herself unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services or may constitute a hazard or embarrassment. In such case, Our liability shall be strictly limited to refund of the recoverable cost, if any, of any unused portion of the tour.
You and Your companion shall agree to indemnify and hold Us harmless from and against any costs, damages, losses or liabilities arising out of Your companions’ claims that the You are not authorized to agree to this Terms and Conditions Agreement on their behalf, when You have registered and initiated the crowdfunding process on this Site.
REPRESENTATIONS, WARRANTIES, AND ACCOUNT CANCELLATION
No warranty or representation is given, endorsed or implied by Us with regard to the authenticity and validity of the crowdfunding purpose, its intent or the fundraiser. Any transaction in the form of a fund contribution is deemed only as a paid amount to and on-behalf of your account made payable to Us with your intent to purchase a honeymoon trip from Us. Once a payment has been made into your funding account, it shall be held as a credit to the balance of the intended tour purchase until a specific period, which is to be 60 days before the intended travel date, whereupon full redemption will be made as in a purchase of that specific tour chosen by You.
Any cancellation of account prompting withdrawal of available fund will have the specific cancellation charges that are listed as follows:
10 percent of fund already collected in account when cancellation and withdrawal are made 60 days or more before travel departure date;
20 percent of fund already collected in account when cancellation and withdrawal are made between 30 and 59 days before travel departure date; and
No refund is allowed for any cancellation made in less than 30 days before travel departure date.
All cancellations must be addressed to Us as a written communication. No verbal cancellations can be accepted.
Any withdrawal of fund from the account shall not include contributions made into the account via discounts, discount codes, referral codes, or through any other form of non-financial credits beyond credit card, PayPal, WePay, bank transfer, check deposit, cash or any other electronic payment systems.
CHANGES AND UPDATES
CLAIMS AND MEDIATION
If a dispute arises out of or relates to this Terms and Conditions Agreement as a result of any claim, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by a mediator experienced in the travel industry under the Commercial Mediation Procedures of the American Arbitration Association before resorting to arbitration, litigation, or some other dispute resolution procedure.
We will not discuss or disclose any information about guests’ personal data or trip details with any third party other than the client’s authorized travel partner on the reservation, the airlines, hotels, land, cruise operators, and the relevant and necessary business suppliers for this tour arrangement.
ERRORS AND OMISSIONS
This site and its components are offered for informational purposes only; this site shall not be responsible or liable for accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information.
